zeitkapsl provides cloud-based mobile and desktop storage apps. The security and protection of data is ensured by end-to-end encryption. Users can access zeitkapsl’s services through our website at https://zeitkapsl.eu/ or through our apps available on the Google Play Store and Apple Store. Subscribers can:

  • Encrypt their files using user-controlled encryption,
  • Upload, access, store, manage, share, communicate, download and decrypt files and other data; and
  • Grant others (“Authorized Persons”) access to their data and files.

General Terms

Use of the Service is at your own risk. The Service is provided on an “as is” and “as available” basis. Technical support is offered via email at support@zeitkapsl.eu.

The Company makes no guarantees about the reliability of the Services or the security of user data, despite best efforts. The Service is provided “as is” and “as available”, without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, accuracy, non-infringement, or warranties arising from course of dealing or usage.

The Company does not warrant that the Service will meet your specific requirements, the Service will be uninterrupted, timely, secure, or error-free, the results that may be obtained from the use of the Service will be accurate or reliable, the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations, and errors in the Service will be corrected.

You understand that the Company uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to operate the Service. See Privacy Policy

You may not modify, adapt, or hack the Service.

You may not modify another website to falsely imply affiliation with the Service or the Company.

You agree not to reproduce, duplicate, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service without express written permission from the Company.

Verbal, physical, written, or other abuse (including threats or retaliation) toward any customer of the Service or any employee of the Company will result in immediate account termination.

Account Terms

You are responsible for the security of your account, recovery key and password. We recommend that you use “strong” passwords (passwords that contain a combination of upper and lower case letters, numbers and symbols). The Company cannot and will not be liable for any loss or damage caused by your failure to comply with this security obligation.

You must provide your full legal name, a valid email address and any other information requested to complete the registration process.

During account creation, you will be asked to verify your email to complete your registration.

During successful account registration, we will provide you with the recovery key, which you should download and keep safe. This recovery key can be used to access your account in case you have lost access to your password. Therefore, this recovery key should not be shared with others. It should be noted that we do not have access to the content itself. If the recovery key and password are lost, the content will no longer be accessible.

By providing your email address, you agree to receive service-related communications, including any notices required by law, in lieu of communications via postal mail.

You are responsible for all media content stored under your account. You must not use the Service for any illegal purpose or violate any laws in your jurisdiction (including but not limited to copyright laws).

You must be human. Accounts registered by “bots” or other automated methods are not permitted.

Any use or access of zeitkapsl’s Services by anyone under the age of 18 is strictly prohibited and violates this Agreement.

If you connect to the Service through a third-party service, you grant us permission to access and use your information from that service in accordance with the terms of that service, as well as to store your login information and other data obtained from that service.

If you exceed your storage limit, zeitkapsl will stop backing up your files and data and you will receive an email notification of this. However, the files already backed up will remain accessible as long as they have an active subscription.

The Company reserves the right to suspend or terminate your account in the event that an investigation is conducted based on a report of abuse.

We may, but are not obligated to, remove content and accounts that we deem, in our sole discretion, to be unlawful or infringe any party’s intellectual property rights or these Terms and Conditions.

If you allow others (authorized persons) to access your data (e.g., through sharing features such as public links within zeitkapsl), those authorized persons must accept these Terms. You are responsible for the acts and omissions of the authorized persons while using zeitkapsl’s services. You also agree to fully indemnify us against any claims, losses, damages, fines, costs (including our legal fees) and other liabilities resulting from any violations of these Terms by authorized persons.

Payment Terms

Our paid subscriptions are recurring and renew indefinitely, either monthly or annually, depending on the subscriber’s chosen paid plan. The price must be paid in advance. The prices listed include Austrian VAT (20%). The currency is EURO.

Paying for your subscription with fraudulent means of payment, such as a stolen credit card, is prohibited.

Downgrading to a lower plan level will result in the new plan being billed from the next billing cycle. Pro-rated billing will be applied for the current billing cycle, which may result in a credit. Credits will be deducted from the next bill. Should you prefer to have any excess amounts refunded, please contact us at support@zeitkapsl.eu.

Upgrading to a higher plan level will result in a new billing cycle. The new plan will be billed immediately, less pro-rated billing for the current billing cycle.

Downgrading your Service may result in loss of features or capacity (e.g. lower storage capacity) of your account. The Company will not be liable for such losses. Please note that downgrading is only possible if the quota limit of storage capacity and number of user accounts is not exceeded after downgrading.

If at any time you fail to make payment to us without notice of termination, we may suspend or terminate your use of the Service. In addition, we may also pursue any other rights or remedies available to us in such cases.

Cancellation, Termination and Refund Policy

You are solely responsible for properly terminating your account. An email or phone request to terminate your account does not constitute termination. You may terminate your account at any time by clicking on the “Settings” link in the global navigation bar at the top within the three-dot menu on the screen. On the Settings interface, you will find a simple link to cancel or delete your account with no questions asked.

If you cancel your current subscription, it will remain active until the end of the paid subscription period. After the subscription period ends, all of your content will be inaccessible. However, your account can be reactivated within 14 days. After the expiration of those 14 days, all photos and videos will be permanently deleted from active systems. All other personal information that is no longer required to be retained by law will be permanently deleted from active systems within 60 days and from our backups after an additional 30 days. This information cannot be recovered once it is permanently deleted.

The Company reserves the right, in its sole discretion, to suspend or terminate your account and refuse any and all current or future use of the Service for any reason and at any time. Such termination of the Service will result in the deactivation or deletion of your account or your access to your account and the loss and abandonment of all content in your account. The Company reserves the right to refuse Services at any time and for any reason.

Changes to the Service and Prices

The Company reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, any part of the Service with or without notice.

Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Your continued use of the Service after such changes constitutes your acceptance of such changes.

Prices of all Services are subject to change upon 30 days’ notice from us. Such notice may be given at any time by posting the changes on the zeitkapsl website, by email, or in the Service itself.

The Company shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

All content uploaded to the service must comply with Austrian copyright laws. We do not claim any intellectual property rights over the media content you provide to the service. All uploaded media content remains your property.

The company does not review content, but reserves the right (but not the obligation) in its sole discretion to refuse or remove any content available through the service. Content that has been reported may be removed and/or blocked by zeitkapsl at any time.

Accuracy and confidentiality of your data

You are responsible for ensuring that all of the data you provide is complete and accurate at all times.

You must notify us of any changes to your data or you can update it in your customer account. You are responsible for keeping your access data confidential and protecting it from unauthorized access. If you suspect that your access data or other data has been misused by unauthorized persons, you must inform us immediately in order to prevent cases of fraud.
